TERMS AND CONDITIONS

These terms and conditions apply to all offers, orders, deliveries and agreements between Autumn Wheels, hereinafter referred to as "seller", and the customer, hereinafter referred to as "buyer". By placing an order on www.autumn-wheels.com, the buyer agrees to these terms.

APPLICABILITY

All prices are stated in euros, including VAT (21%) and excluding shipping costs, unless explicitly stated otherwise.

Shipping costs are clearly communicated before completing the order. Rates:

  • Netherlands: free shipping from €75; below that €7.95.
  • Europe: free shipping from €200; below that varying between €14.95 and €24.95.
  • For all countries outside Europe, a fixed shipping rate of €50 per order applies.

Any import duties, levies and additional customs costs for deliveries outside the EU are entirely at the buyer's expense.

Autumn Wheels reserves the right to change prices. Ongoing orders are always delivered at the price that applied at the time of purchase.

PAYMENT

Orders must be paid in advance via the offered payment methods (including iDEAL, credit card, PayPal, Klarna, Apple Pay and Google Pay).

An agreement only comes into effect after payment has been successfully received by Autumn Wheels.

If payment is not made within ten working days, Autumn Wheels reserves the right to cancel the order.

DELIVERY AND EXECUTION

After receiving an order, the buyer receives an order confirmation by email. This indicates whether the product is directly available from stock, or whether it is a pre-order or product in production.

Orders are only processed and shipped after payment has been fully received by Autumn Wheels and the buyer has received a shipping confirmation from Autumn Wheels by email.

If the ordered products are in stock, Autumn Wheels strives to ship orders within the following periods after shipment:

  • Netherlands: 1–2 working days
  • Europe: 3–5 working days
  • Outside Europe: 7–10 working days

Mentioned delivery times are indicative and depend on the carrier; no rights can be derived from this.

If the ordered products are not directly in stock (for example with pre-orders or production on request), the buyer will be informed about this with an expected delivery time. Autumn Wheels does its utmost to meet these deadlines, but delays in production or transport can never lead to compensation.

Delivery takes place via recognized parcel services such as PostNL, DHL or UPS. Autumn Wheels takes care of correct and safe shipping, but the risk of loss, theft or damage during transport passes to the buyer as soon as the package is transferred to the carrier. Any damage claims must be submitted directly to the relevant carrier.

If delivery proves impossible due to incorrect or incomplete data provided by the buyer (for example an incorrect delivery address), Autumn Wheels is not liable for delay or loss and any additional costs are at the buyer's expense.

RIGHT OF WITHDRAWAL AND RETURNS

The buyer has the right to cancel the agreement within fourteen days after receipt of the order, without giving reasons (right of withdrawal). During this cooling-off period, the buyer must handle the product and packaging carefully. The product may only be unpacked or used to the extent necessary to determine its nature, characteristics and operation.

Return costs are at the buyer's expense, unless it concerns an error or shortcoming by Autumn Wheels. Damage that occurs during transport of the returned product is also at the buyer's expense, unless this damage is the result of an error or shortcoming by Autumn Wheels.

Upon correct return, the buyer receives the purchase amount back within fourteen days after receipt of the return shipment via the same payment method with which the original transaction took place.

WARRANTY PERIOD AND CONDITIONS

Autumn Wheels guarantees that its products are free from material and manufacturing defects for a period of two (2) years from the original purchase date.

The warranty applies exclusively to the first owner of the product and is not transferable. The warranty only covers defects that make the product unsuitable for normal use or significantly limit its use.

WARRANTY EXCLUSIONS

Autumn Wheels warranty does not cover damage caused by:

  • Incorrect or injudicious use of the product.
  • Not following the use or maintenance instructions.
  • Normal wear or aging.
  • Accidents, falls or external influences (such as transport or assembly damage).
  • Changes or adjustments to the product that were not carried out by Autumn Wheels or an authorized dealer.
PARTS SUBJECT TO WEAR

The following parts and zones are considered wear parts and therefore are not covered by warranty:

  • Brake pads.
  • Braking surface of carbon rims.
  • Ball bearings.
  • Decals and paint layers that wear due to normal use or external influences.
IMPORTANT USAGE INSTRUCTIONS

Only use brake pads suitable for carbon rims when using fully carbon wheels from Autumn Wheels.

Always change brake pads when alternating between aluminum and carbon rims. Remaining dirt particles can cause irreparable damage to the carbon braking surface.

Failure to follow these instructions may result in warranty exclusion.

HANDLING WARRANTY CLAIMS

Any warranty claims must always be submitted in writing and with proof of purchase to Autumn Wheels.

Autumn Wheels assesses the report and determines whether the damage falls within the warranty conditions.

If a defect is covered by warranty, Autumn Wheels will repair, replace or offer a suitable alternative at its own discretion.

Any shipping costs for sending the product to Autumn Wheels are at the buyer's expense, unless expressly agreed otherwise.

CRASH REPLACEMENT

At Autumn Wheels we don't leave you stranded after an accident. That's why we offer a special Crash Replacement Program that allows you to get replacement rims at a service price. This program applies exclusively to the original buyer. You can find all details and complete conditions in our Crash Replacement Policy.

RETENTION OF TITLE

All products delivered by Autumn Wheels remain the property of Autumn Wheels until full payment has been received. Until that time, we ask our customers not to resell, pledge or otherwise transfer the products to third parties.

INTELLECTUAL PROPERTY

The designs, images, texts, product names, logos and other expressions on our website and products are the property of Autumn Wheels. These may not be used, copied or distributed without prior written permission from Autumn Wheels. This way we can guarantee the quality and exclusivity of our products and brand identity.

APPLICABLE LAW AND DISPUTES

Dutch law applies to all agreements and these general terms and conditions. We strive to always resolve any disputes together with the customer in good consultation first. If this unfortunately does not succeed, the dispute will be submitted to the competent court in the district where Autumn Wheels is located.

Rental Terms and Conditions – Autumn Wheels

At Autumn Wheels, we want you to travel with your bike without any worries. Our bike cases are designed to transport your bicycle safely during holidays, cycling trips, and travels. A bike case is a product that is used intensively, and normal signs of wear may occur. Small scratches, light wear, or other marks consistent with normal use are not a problem. If damage occurs unexpectedly during the rental period, we will always look at what happened and work towards a suitable solution. Clear agreements in advance ensure that everyone knows where they stand.

Article 1 – Definitions

Autumn Wheels: the rental provider of bike cases. Renter: the person or organisation renting a bike case from Autumn Wheels. Bike case: the bike case offered by Autumn Wheels, including any accessories and components. Rental agreement: the agreement between Autumn Wheels and the renter regarding the rental of a bike case. In writing: communication via email or other digital communication channels.

Article 2 – Applicability

These rental terms and conditions apply to all reservations, offers, and rental agreements of Autumn Wheels. By placing a reservation, the renter agrees to these terms and conditions.

Article 3 – Reservation and Payment

A reservation is confirmed once Autumn Wheels has confirmed the request. The rental price is determined based on the current rates as listed on the website or as agreed in writing. The full rental amount must be paid no later than 3 days before the start of the rental period. For reservations made within 3 days before the start date, payment is due immediately upon confirmation. Autumn Wheels does not require a deposit for renting a bike case. Any costs arising from failed payments, chargebacks, or payment arrears may be charged to the renter.

Article 4 – Delivery and Return

The bike case is delivered via the agreed parcel service to the address provided by the renter. The renter is responsible for providing a correct delivery address and for being available to receive the bike case in time. The rental period starts on the agreed start date. The renter must return the bike case no later than the agreed return date, following the return procedure specified by Autumn Wheels.

The return shipment must be correctly packaged and labelled with the correct shipping information, and handed over to the designated carrier. The risk for the bike case during the return shipment lies with the renter until the shipment has been scanned as submitted by the carrier. Autumn Wheels advises the renter to retain proof of submission. The rental period ends once the bike case has been correctly submitted for shipment in accordance with the agreed return procedure. If the bike case is not returned on time, Autumn Wheels may charge additional rental fees until the return shipment has been correctly submitted.

Article 5 – Use of the Bike Case

The renter must handle the bike case with care and use it solely for its intended purpose: transporting a bicycle. The renter must take appropriate measures to prevent damage, loss, and theft. The bike case may not be sublet, lent out, or made available to third parties without the prior consent of Autumn Wheels. The renter must return the bike case in the same condition as it was received, taking into account normal signs of wear.

Article 6 – Damage, Loss, and Theft

A bike case is a consumer product. Normal signs of wear such as small scratches, light wear, or cosmetic damage resulting from normal use do not constitute damage. Autumn Wheels advises the renter to inspect the bike case upon receipt and to report any pre-existing damage immediately by email, preferably with photos. If no report is made upon receipt, the bike case is deemed to have been received in good condition. If damage beyond normal wear occurs, Autumn Wheels will assess the situation and determine an appropriate solution.

In the event of damage caused by careless use, misuse, loss, or theft, the costs of repair, restoration, or replacement may be charged to the renter. In the event of loss, theft, or total loss of the bike case, the replacement value may be charged. The replacement value of the bike case is €450 including VAT. If parts are missing or the bike case is returned incomplete, the costs of replacement or repair may be charged. The renter must report damage, loss, or theft to Autumn Wheels as soon as possible and no later than 24 hours after the incident.

Article 7 – Transport During the Trip

When the bike case is transported by third parties during a trip, such as airlines, carriers, or other transport companies, the responsibility for this transport lies with the renter. Autumn Wheels is not liable for damage, loss, theft, or delay caused by these external parties. The renter is responsible for checking the terms and conditions of the relevant carrier and may, if desired, take out appropriate travel or transport insurance.

Article 8 – Cleaning

The bike case must be returned empty and clean. Normal soiling from use is not a problem. If the bike case is returned excessively dirty, for example due to large amounts of sand, mud, or other contamination, reasonable cleaning costs may be charged.

Article 9 – Cancellation and Changes

A reservation can be cancelled free of charge up to 14 days before the start of the rental period. For cancellations between 7 and 14 days before the start of the rental period, 50% of the rental amount will be charged. For cancellations within 7 days before the start of the rental period, the full rental amount remains due. Cancellations must be made in writing by email to info@autumn-wheels.com. The cancellation is valid from the moment Autumn Wheels has confirmed the cancellation by email. Changes to a reservation are possible if they fall within the availability of Autumn Wheels and must also be requested in writing.

Article 10 – Cancellation by Autumn Wheels

Autumn Wheels reserves the right to cancel a reservation in the event of force majeure, damage to or loss of the bike case prior to the start of the rental period, or other circumstances that make delivery reasonably impossible. In the event of cancellation by Autumn Wheels, the renter will receive a full refund of the rental amount. Autumn Wheels is not liable for any further costs or damages resulting from the cancellation, such as travel costs or booking fees with third parties.

Article 11 – Liability of Autumn Wheels

Autumn Wheels ensures that the bike case is delivered in good and usable condition at the start of the rental period. Autumn Wheels is not liable for damage arising from the use of the bike case, the transport of the bicycle, or circumstances beyond the control of Autumn Wheels. Autumn Wheels is not liable for indirect damage, such as missed flights, travel delays, additional accommodation costs, or other consequential damages.

Article 12 – Personal Data

Personal data provided during a reservation is used solely for the purpose of executing the rental agreement. Autumn Wheels processes personal data in accordance with applicable privacy legislation.

Article 13 – Force Majeure

Autumn Wheels is not liable when obligations cannot be fulfilled due to circumstances beyond its control. Force majeure includes, among other things, extreme weather conditions, natural disasters, government measures, disruptions at carriers, or other unforeseen circumstances.

Article 14 – Applicable Law and Disputes

All rental agreements with Autumn Wheels are exclusively governed by Dutch law. Any disputes will be handled by the competent court in accordance with the applicable legal rules.

By reserving a bike case with Autumn Wheels, the renter declares to agree to these rental terms and conditions.
